Nitrous Oxide Safety Act Clears First House Hearing — Bipartisan Fast Track Confirmed, Culinary Carve-Out Unchallenged

The Nitrous Oxide Safety Act of 2026 (H.R. 7945) passed its first formal test in Congress on July 22, 2026, when the House Subcommittee on Commerce, Manufacturing, and Trade held a legislative hearing on the bill. The measure would prohibit any consumer product containing nitrous oxide under section 8 of the Consumer Product Safety Act, with written exceptions for medical and dental treatment, commercial production of food or food products, and research and development. For food-service suppliers, the hearing confirms two things: the bill has real bipartisan momentum, and the culinary carve-out survived its first public scrutiny unchallenged.

What Happened at the Hearing

Rep. Kevin Mullin, the bill's author, told InvestigateTV the hearing itself came faster than expected. "We were a little bit surprised that we're actually getting this hearing so quickly after introducing the Nitrous Oxide Safety Act," he said. "But I think it's indicative of the bipartisan support of the bill and really a recognition of the dangers that exist out there." The bill is co-sponsored by Rep. Stephanie Bice, giving it authors in both parties.

Mullin's case rests on the lethality trend: a 2025 study found a 500% increase in deaths tied to nitrous oxide abuse between 2010 and 2023, and poison control cases rose from 28 in 2003 to more than 400 in 2024. "This is a national problem," Mullin said. "In my view, this bill is the right approach because of how dangerous nitrous oxide is — regardless of the age of the user." Two mothers who lost children to nitrous oxide addiction appeared in support of the bill, part of a parents' campaign that has pressed Congress since the measure's introduction.

Retail Is Moving Before the Law Does

The consumer channel is closing ahead of any vote. The bill's exception for commercial production of food or food products was not contested, and no witness or member proposed narrowing it. The next step in the process is a subcommittee markup, where amendment language gets voted — that session has not been scheduled yet, and it is the first place the food-production clause could realistically change.
